A consent form template is ready-made wording that asks a person to agree to be contacted. Below is one for calls and texts about your offers, built on the FCC’s rule, and how Kapture keeps proof that the person agreed. This is a summary, not legal advice.
The template
Put this next to an unchecked box, above the Submit button. Fill in the parts in brackets.
Fields: Name · Phone number · Email
☐ By checking this box and clicking Submit, I agree that [Company name] may call and text me about [products or services] at the phone number I entered, including calls and texts made with an autodialer, and calls with a prerecorded or artificial voice. I understand I do not have to agree to this to buy anything. I can take back my consent at any time, for example by replying STOP to a text.
Why each part is there
| Part | Why it is there |
|---|---|
| Your company name | The agreement has to authorize the seller to make the calls, so name who will call (47 CFR 64.1200(f)(9)). |
| The phone number | The agreement names the number the calls and texts go to (64.1200(f)(9)). |
| Autodialer and prerecorded voice | The person must be told that agreeing allows these calls (64.1200(f)(9)(i)(A)). |
| Not required to buy | The person must be told they do not have to agree in order to buy anything (64.1200(f)(9)(i)(B)). |
| The box and the Submit button | The agreement must be signed, and an electronic signature counts (64.1200(f)(9)(ii)). A box the person ticks themselves shows they chose to agree. |
| How to stop | People can take back consent in any reasonable way, like replying STOP to a text, and you must honor it within 10 business days (64.1200(a)(10)). |
How Kapture records the person agreeing
Kapture reads the consent: it captures the exact wording on the page, word for word, the moment the person agrees.
- The page as they saw it. A replay of the form, the consent wording included.
- What they did. The box they ticked and the Submit click, with the time of each.
- Who they are. The name and phone number as they typed them.
- Kept by you. A tamper-proof record in your own connected storage, with an ID that travels with the lead.
Kapture is $0.001 per lead recording, or $0.005 a hosted form with recording, with your own connected storage. New accounts get 2,000 free tokens, no card needed.
A record shows what happened. It can’t fix wording that was wrong to begin with, so have a lawyer check your form for your business and your states.
