Electronic signature wording
Electronic signature wording is the short text next to the sign button that tells people they are signing, and that they agree to sign online. Clear words help show that the person meant to sign.
Why the words matter
Under US law, an electronic signature is a sound, symbol or process a person uses with the intent to sign (15 U.S.C. 7006). Clear wording helps show that intent.
Sample wording
- Next to the sign button: “By clicking Sign, I agree that this is my electronic signature, and that it has the same effect as my handwritten signature.”
- Agreeing to sign online: “I agree to sign this document electronically and to get records about it by email.”
- For a typed name: “Typing my name below is my signature.”
What E-SIGN asks you to tell a consumer
- When it applies: a law says a consumer must get certain information in writing, and you want to send it electronically instead (15 U.S.C. 7001(c)).
- They can ask for paper. Tell them they can get the record on paper, how to ask, and whether there is a fee.
- They can change their mind. Tell them they can take back their consent, how to do it, and what happens if they do.
- What it covers. Say if the consent is for this one deal, or for other records too.
- What they need. Tell them the device and software they need to open and keep the records.
- They show they can open it. They agree in a way that shows they can open the files you will use.
