TCPA consent management, step by step

TCPA consent management is everything you do with a person’s yes to calls and texts: get it the right way, keep proof of it, send that proof along with the lead, stop when they say stop, and keep the records long enough. Here are the five jobs in plain English, and the tools that do them. This is a summary, not legal advice.

Not the cookie banner

“Consent management platform” often means the cookie banner on a website. TCPA consent is different. It is a person agreeing to marketing calls and texts, and it has its own rules from the FCC and the FTC.

The five jobs of TCPA consent management

1. Get consent the right way
For marketing calls by autodialer or recorded voice, the FCC wants written consent. The wording has to say clearly what the person agrees to, say that agreeing is not needed to buy anything, and be signed. An electronic signature counts. Sample consent language →
2. Keep proof of it
The FTC lists five things a consent record must hold, including a copy of the request “in the same manner and format” the person saw it. A recording of their real session covers that. A screenshot of today’s form does not. What a consent record has to contain →
3. Send the proof with the lead
Give each record an ID that travels with the lead to every buyer, so anyone who calls can check the consent before they dial.
4. Stop when they say stop
A person can take consent back in any reasonable way, like replying STOP. Under the FCC rule you have up to 10 business days to stop calls and texts. That list lives in the systems that call and text, like your dialer and texting tool. How revoking consent works →
5. Keep the records long enough
Federal TCPA claims can be brought for four years after each call, and the FTC telemarketing rule asks for five years of records. Work out your keep-until date →

What Kapture does

  • Records the real session. The page as the person saw it, the consent wording, the box they ticked and the submit, second by second.
  • Keeps a tamper-proof record in storage you own, for as long as you keep it.
  • Gives each lead an ID in a hidden form field, so it travels to every buyer, and a dialer can check it through the API before it calls.
  • Costs $0.001/certificate a lead with your own storage, at every volume.

Kapture keeps the proof. It does not make you compliant, and no tool can promise a TCPA outcome. If a buyer’s contract names TrustedForm or Jornaya, keep that tool for that buyer. Have counsel review your consent wording.
